TERMS OF BUSINESS – FOR BUSINESSES, ADVERTISERS AND SUPPLIERS
These are the Terms of Business on which you (the ‘Client’) agree to use the dasja.co.uk service (the ‘Service’) as provided by Dasja (SOGI ENTERPRISES’). Your use of the Service will be deemed to indicate your acceptance of these Terms of Business. Prior to any advertising on dasja.co.uk, the Client must primary register and sign up their corporate via our online registration form, e-registration form, or registration form providing you have understood and accepted full terms and conditions of Dasja summarised below:
1. TERM & ACCEPTANCE
i. Our directory listings are all confirmed on a fixed term 12 month minimum (unless stated otherwise), ii. Solely directory listings: standard, silver and gold may be purchased online at dasja.co.uk, additional advertising: banner listings, homepage advertising must be requested subject to submit email enquiry. Thus we also have a network of various skilled field sales executives operating in regional areas.
2. THE SERVICE
i. Dasja will: (a). permit the general public to access an asian occasion directory web site at www.dasja.co.uk (the ‘Web Site’) which contains directory details of local businesses which supply/sell products/services in summary to wedding, anniversaries, birthdays and other occasions also related information on which the client will have a priority listing including their business name, type of service, area, etc. (b). the online directory will be updated on a regular basis, adding more categories, enhanced features and improving our services; (c). all directory listings will provide, where possible, name and address, the email address, telephone/mobile number and description of service/products of the client, company logo/picture, website address, discount voucher (except for‘ Gold’ service where we provide additional map & direction, along with picture slideshow, website url) (d). where appropriate display the logo supplied by the Client on the Web Site and where possible a hypertext link to the Client’s website; (e). in order to maintain the availability and performance of the Web Site, although scheduled maintenance and continual improvements may require us to make the service temporarily unavailable; (f). where possible provide the Client with user statistics in the form of an email report at extra cost; (g). provide an private email messaging facility for the transmission of enquiries directly from the Web Site to the Client; (h). where possible provide the Client with an dasja.co.uk branded window card or sticker to be displayed by the Client in a prominent position of their shop front window, company car etc; (i). grant the Client a royalty-free licence to use the dasja.co.uk logo and name in any advertising or promotional or marketing displays (j). use reasonable resources to market the Web Site to prospective target audience. To achieve this, we reserve the right to negotiate and enter into online distribution agreements with third parties. ii. The Client will: (a). be responsible for the provision, operation and support of any hardware, Internet connections and browser software necessary for effective use of the Service; (b). not copy any element (including any source code) of the Service without the express written consent of Dasja; (c). will use reasonable resources to pass accurate Data to the Web Site; (d). pay Dasja for the right to use the Service in accordance with the Services Agreement (the ‘Fees’); (e). grant Dasja a royalty free licence for the reasonable use of the Client’s name, logo, pictures and other trade marks on the Web Site. (f). takes full precautions when editing its own listing(s), incl wording errors, image resizing, discount vouchers etc. (g). makes sure password is changed frequently, also is solely responsible to obtain its user login and password confidential and private. iii. The Client’s right to use the Service is non-transferable and non-exclusive. The Client may permit its staff, employees, subsidiary companies, contractors or agents to use the Service on its behalf provided that it procures their compliance with these Terms of Business.
3. WARRANTY AND LIMITATION OF LIABILITY
i. Dasja makes no warranty that the Service will continue uninterrupted or free from errors that materially affect the performance of the Service. ii. We endeavour to offer a money back guarantee on limited packages inc standard. Means Client will be able to reclaim up to total advertising costs providing we have been unsuccessful to generate awareness and traffic inc leads to your business and your listing with us. Client must submit claims application 14 days prior to its renewal is due, claims are refunded in either (vouchers or cheque) payments solely at discretion of management. We aim to resolve all claims minimum 28 days. iii. Dasja has the complete right under management discretion to refuse any refunds, including money back guarantee to clients which may believe be part of con, scam, mislead carried out by client. iv. Except liability in the event of death, personal injury or fraud caused by Dasja or any liability incurred by the Client as a direct result of DASja uploading the Data in a form materially different to that uploaded by the Client to any media other than the Web Site, Dasja will not be liable to the Client, whether for
